Privacy Policy

The Sketchbook Gallery (the "Gallery") at mcahogarth.org/gallery is operated by M.C.A. Hogarth ("we," "us," or "our"), located in Florida, United States. This Privacy Policy explains how we collect, use, and protect information when you use the Gallery (the "Service"). By using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service.

1. Information We Collect

We collect only minimal data necessary to provide the Gallery:

  • A unique identifier (Google ID) received from Google Sign-In. We request only the "openid" scope — no name, email, or profile picture.
  • A display name you choose during account setup. This is a pseudonym you create; it is not linked to your real-world identity.
  • Your preferences and activity within the Gallery: theme preference, favorited images, and a count of images viewed each month (used to manage your browsing budget).
  • Written notes ("chatter") you choose to post on artwork pages, including their edit history dates, and the list of artwork pages you follow for notification purposes.
  • Records of recognitions ("accolades") the artist has attached to your notes.

We do not collect emails, real names, location data, IP addresses, payment details, or any other personal information. Notes are free-text you author; please do not include personal information about yourself or others in them.

2. No Email Collection or Communication

The Gallery does not collect your email address, and we will never send you email for any reason — no marketing, no notifications, no password resets. All announcements are made through our Patreon, Locals, and Discord channels. If you need to contact us, you may do so at the address in Section 9, but we will never initiate contact with you by email. Notifications about activity on pages you follow are delivered only inside the Gallery, on-site, when you are signed in. Nothing is ever sent to you.

3. How We Use Information

  • Your Google ID authenticates your account and allows access to the Gallery.
  • Your display name is shown alongside your activity (e.g., on your profile and favorites page) and is visible to other users and the site administrator.
  • Your monthly image view count determines your remaining browsing budget under your access tier. View counts reset on the first of each month.
  • Your theme preference controls the visual appearance of the Gallery for your sessions.
  • Notes you post are displayed with your display name to other signed-in members on the artwork's page and in members-only activity feeds. Notes are never shown to visitors without accounts and never included in public feeds (such as RSS).

We do not use your data for marketing, advertising, or profiling.

4. Third-Party Services

  • Authentication: We use Google Sign-In. Google handles your login; review their Privacy Policy at policies.google.com/privacy.
  • Access Codes: Supporter access is provided through codes distributed via Patreon, Locals, or through passes purchased on our Shopify store (studiomcah.com). We do not store or access payment information. Please review the privacy policies of Patreon, Locals, and Shopify respectively.

5. Children's Privacy

The Gallery contains artwork depicting complex emotional content, nudity, and violence. It is intended for users 13 years and older. We do not knowingly collect data from children under 13. If we learn of such data, we will delete it immediately. Parents or guardians may contact us to request removal.

6. Sharing and Disclosure

We do not sell, rent, or share your Google ID or Gallery data with third parties, except to service providers (Google, payment processors) under strict confidentiality agreements, or if required by law or to protect our rights.

7. Data Security

We use reasonable measures (e.g., encryption, secure hosting, server-side sessions with HTTP-only cookies) to protect your data. However, no system is 100% secure.

8. Data Retention

We retain your Google ID and Gallery data while your account is active or as needed for legal purposes. Accounts inactive for more than two years may be deleted.

Notes you post are retained while your account is active. If you delete your account, all of your notes are permanently removed by default. During deletion you may instead choose to leave your notes in place with your name permanently removed from them ("unsigned"); this choice is optional, and once made, unsigned notes can no longer be traced to you and cannot be reclaimed. You may also delete any individual note yourself at any time.

9. Your Rights

You may request access, correction, or deletion of your data by emailing jaguar@mcahogarth.org. We will respond promptly.

10. Changes to This Policy

We may update this Policy from time to time. Changes will be posted here with the updated date. Continued use of the Service constitutes acceptance of the revised Policy.

Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Sketchbook Gallery at mcahogarth.org/gallery ("Service"), operated by M.C.A. Hogarth ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. The Gallery contains artwork depicting complex emotional content, nudity, and violence. By using the Service, you confirm you are 13 or older and understand the nature of this content.

2. Account and Authentication

We use Google Sign-In (openid scope only) for authentication. You are responsible for maintaining the security of your account. We may suspend or terminate accounts for violations of these Terms. You may not create or use multiple accounts.

3. Access Tiers and Browsing Budget

The Gallery uses a tiered access system:

  • Tourist (free): A monthly budget of image views, resetting on the first of each month.
  • Explorer: An expanded monthly budget, available through access codes.
  • Chimerical Denizen (supporter): Unlimited access to the full archive.

Access codes are distributed via Patreon, Locals, or through duration passes purchased on our Shopify store. Codes are single-use and grant access for a defined period. Access tiers carry no ownership rights and no real-world monetary value.

4. Purchases

Duration passes (season and annual) are final and non-refundable except as required by law. Supporter access can also be obtained at no additional cost through active Patreon or Locals memberships. Payments are processed by Shopify; we are not responsible for their services.

5. User Conduct

You agree not to:

  • Circumvent, manipulate, or abuse the browsing budget system (e.g., creating multiple accounts, scripting requests).
  • Scrape, bulk download, or systematically copy images from the Gallery.
  • Redistribute, repost, or hotlink Gallery images without written permission.
  • Attempt to reverse-engineer, interfere with, or disrupt the Service.
  • Use the Gallery or its content for training machine learning or AI models.

Notes and community conduct. Community norms for written notes are described on our House Notes page, which forms part of these Terms. In particular, you agree not to:

  • Post notes containing profanity, obscenity, or content that is unlawful, hateful, or sexualizes minors.
  • Harass, badger, demean, or campaign against the artist or any member, including over creative, personal, or belief differences. Members of this community hold widely divergent beliefs; respect is a condition of participation.
  • Use notes for advertising or habitual self-promotion.
  • Share other members' notes or activity outside the Gallery, including by screenshot, or use notes to reveal any person's identity or personal information.
  • Impersonate the artist or any member, or post spam or machine-generated content.

Violations may result in account termination without refund.

6. Your Notes

"Notes" are written responses you post on artwork pages.

Ownership and license. Your notes remain yours. By posting, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and format your notes within the Gallery for as long as they remain posted. If you delete a note, or delete your account and choose full removal, this license ends for that content. If you choose during account deletion to leave notes behind unsigned, this license continues for those unsigned notes.

Attribution. Notes are always displayed with your display name. There is no anonymous posting.

Editing and deletion. You may edit or delete your own notes at any time, except that a note the artist has replied to may become locked against editing shortly after her reply, to preserve the exchange.

Moderation. We may remove, hide, or decline to display any note at any time, at our sole discretion, without notice or explanation. We are not obligated to store, back up, or restore notes. Repeated removals may result in loss of posting privileges or account termination under Section 2.

The artist's replies. Replies written by the artist are her own content and may remain, in edited or excerpted context, even if the note they responded to is later deleted.

7. Intellectual Property

All artwork, designs, code, and content in the Gallery are the property of M.C.A. Hogarth and are protected by copyright. The Gallery represents over 30 years of original creative work.

Viewing access does not grant you any right to reproduce, download, distribute, or create derivative works from Gallery images. You may share links to Gallery pages. You may not copy, sell, or distribute our artwork or assets without written permission.

You grant us a non-exclusive license to display your display name and other account-level content you create within the Gallery. Written notes are governed by Section 6.

8. Account Deletion

You may request deletion of your account by contacting us, or use the deletion option in your account settings. Upon deletion, your account data — including your display name, favorites, view history, followed pages, and access tier — will be permanently removed.

Your written notes are permanently removed by default. During deletion you may instead choose to leave your notes in place, permanently unsigned; unsigned notes cannot later be reclaimed, edited, or re-attributed, since no link to you is retained. The artist's own replies remain in either case. Deletion requests are processed within 30 days.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for data loss, bugs, service interruptions, or indirect, consequential, special, or punitive damages.

Our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us in the preceding 12 months. If you paid nothing, our liability is $0. This cap does not apply to liability for gross negligence, willful misconduct, or violations of law that cannot be limited.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Hillsborough County, Florida. You agree to submit to the personal jurisdiction of those courts.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
